महाराष्ट्र खाजगी शाळांतील कर्मचारी (सेवेच्या शर्ती), विनियमन अधिनियम, १९७७.
क्रमांक संकीर्ण-२०२५/प्र.क्र.६८५/टीएनटी-१. महाराष्ट्र खाजगी शाळांतील कर्मचारी (सेवेच्या शर्ती) विनियमन अधिनियम, १९७७ (१९७८ चा महा.३) याच्या कलम १६ ची पोट-कलमे (१) व (२) यांद्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि बाबचाचतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करुन, महाराष्ट्र खाजगी शाळांतील कर्मचारी (सेवेच्या शर्ती) नियमावली, १९८१ मध्ये सुधारणा करण्यासाठी महाराष्ट्र शासनाने प्रस्तावित केलेला नियमाचा खालील मसुदा, त्याद्वारे परिणाम होण्याचा संभव असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम १६ च्या पोट-कलम (३) अन्वये आवश्यक असल्याप्रमाणे याद्वारे प्रसिद्ध करण्यात येत आहे; आणि याद्वारे असे सूचित करण्यात येत आहे की, उक्त मसुदा दिनांक १२ मार्च, २०२६ रोजी किंवा त्यानंतर महाराष्ट्र शासन विचारात घेईल.
२. उपरोक्त दिनांकास किंवा त्यापूर्वी उक्त मसुद्याच्या संबंधात कोणत्याही व्यक्तीकडून, प्रधान सचिव, शालेय शिक्षण व क्रीडा विभाग, मादाम कामा रोड, हुतात्मा राजगुरु चौक, मंत्रालय, मुंबई ४०० ०३२ यांच्याकडे प्राप्त होणारी हरकत किंवा सूचना शासनामार्फत विचारात घेतली जाईल,
नियमाचा मसुदा
१. या नियमांस, महाराष्ट्र खाजगी शाळांतील कर्मचारी (सेवेच्या शर्ती) (सुधारणा) नियम, २०२६ असे संबोधण्यात यावे.
२. मुख्य नियमाच्या अनुसूची "ब" मध्ये नोंद चार ऐवजी पुढील नोंद समाविष्ट करण्यात येईल.

(चार) शाळांतील शिक्षकेत्तर पदांसाठी अर्हता-
१. कनिष्ठ लिपिक
(एक) सांविधिक विद्यापीठाची कोणत्याही शाखेतील पदवी किंवा शासनाने समतुल्य म्हणून घोषित केलेली इतर कोणतीही अर्हता;
आणि
(दोन) टंकलेखन किंवा संगणक टंकलेखनातील शासनाने अधिकृत केलेल्या सक्षम प्राधिकाऱ्याने दिलेले मराठी टंकलेखनाची प्रत्ति मिनिट ३० शब्द किंवा इंग्रजी टंकलेखनाची प्रति मिनिट ४० शब्द या गतीचे प्रमाणपत्र,
२. वरिष्ठ लिपिक
नियमित वेतनश्रेणीसह कनिष्ठ लिपीक हे पद धारण करणाऱ्या व त्या पदावर ३ वर्षांहून कमी नाही इतकी सेवा पूर्ण करणाऱ्या व्यक्तींमधून ज्येष्ठता-नि-गुणवत्ता या आधारावर सुयोग्य व्यक्तीच्या पदोन्नतीने.
३. प्रमुख लिपिक
वरिष्ठ लिपिक हे पद धारण करणाऱ्या व या पदावर ३ वर्षांहून कमी नाही इतकी सेवा पूर्ण करणाऱ्या व्यक्तींमधून ज्येष्ठता-नि-गुणवत्ता या आधारावर सुयोग्य व्यक्तीच्या पदोन्नतीने,
४. ग्रंथपाल
(एक) सांविधिक विद्यापीठाची ग्रंथालय विज्ञान विषयातील (B.Lib. Sc. or B.Lib.L.Sc.) पदवी किंवा (दोन) मान्यताप्राप्त संस्थेच्या ग्रंथालय विज्ञान विषयाच्च्या पदविकेसह सांविधिक विद्यापीठाची कोणत्याही शाखेची पदवी.
५. प्रयोगशाळा सहायक
मान्यताप्राप्त परीक्षा मंडळातून इयत्ता १२ वी (विज्ञान) उत्तीर्ण
६. शिपाई
मान्यताप्राप्त परीक्षा मंडळातून किमान १२ वी उत्तीर्ण झालेल्या व्यक्तीमधून वेळोवेळी शासनाच्या मान्यतेने विभागाने विहीत केलेल्या धोरणानुसार अनुकंपा तत्त्वावरील नियुक्ती.
टीप. ज्येष्ठता-नि-गुणवत्ता या कसोटीचे काटेकोररीतीने पालन करून कर्मचारीवर्गामधून पदोन्नतीची पदे भरण्याच्या प्रयोजनास्तव, अनुसूची "फ" मध्ये निर्दिष्ट केलेल्या मार्गदर्शक तत्त्वांच्या आधारे "ज्येष्ठता" निश्चित करण्यात येईल; आणि नियम ३ च्या पोट-नियम (६) खालील स्पष्टीकरणातील "गुणवत्ता" या शब्दाच्या अर्थातर्गत, सेवा अभिलेखानुसार ती निश्चित करण्यात येईल.

NOTIFICATION
MAHARASHTRA EMPLOYEES OF PRIVATE SCHOOLS (CONDITIONS OF SERVICE) REGULATION ACT, 1977.
No. Sankirn2025/C.R.685/TNT-1.- The following draft of rules to amend the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981, which the Government of Maharashtra proposes to amend in exercise of the powers conferred by sub-section (1) and sub-section (2) of section 16 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 (Mah. III of 1978) and of all other powers enabling it in that behalf, is hereby published as required by sub-section (3) of section 16 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration by the Government of Maharashtra on or after the day of 12th March, 2026.
2. Any objections or suggestion which may be received by the Principal Secretary, School Education and Sports Department, Mantralaya, Hutatma Rajguru Chowk, Madam Cama Marg, Mumbai- 400 032, from any person with respect to the said draft on or before the aforesaid date, will be considered by the Government.
DRAFT RULES
1. These rules may be called the Maharashtra Employees of Private Schools (Conditions of Service) (Amendment) Rules, 2026.
2. In Schedule "B" of the principal Rules, for entry IV, the following entry shall be substituted namely:-
"IV. Qualification for non-teaching posts in Schools-
1. Junior Clerk
(i) Bachelor's Degree of any discipline of a statutory university or any other qualification declared by the Government as equivalent thereto;
and
(ii) a certificate in typewriting or computer typewriting awarded by the competent authority authorized by the Government with a speed of not less than 30 words per minute in Marathi Typewriting or 40 words per minute in English Typewriting.
2. Senior Clerk
By promotion of a suitable person from amongst the persons holding the post of Junior Clerk with regular pay scale for not less than 3 years on the basis of seniority-cum-merit.
3. Head Clerk
By promotion of a suitable person from amongst the persons holding the post of Senior Clerk for not less than 3 years on the basis of seniority-cum-merit.
4. Librarian
Bachelor's Degree in Library Science (B.Lib.Sc. or B.Lib.L.Sc.) of a Statutory University
or
Bachelor's Degree in any discipline of a statuary university with Diploma in Library Science from a recognized institution.
5. Laboratory Assistant
Passing 12th standard (Science) from a recognized Board of Examination.
6. Peon
By appointment on Compassionate Ground as per the policy prescribed by the Department with the approval of Government from time to time, from amongst the persons who have passed 12th standard from a recognized Board of Examination.
Note. For the purpose of filing in the promotional post from among the staff strictly on the basis of the seniority-cum-merit, the seniority shall be determined on the basis of guidelines mentioned in Schedule "F" and merit shall be determined in accordance with the record of service within the meaning of that expression in the Explanation below sub-rule (6) rule 3.
