A BILL TO PREVENT UNFAIR MEANS IN THE COMPETITIVE EXAMINATIONS AND TO PROVIDE FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.
सन २०२४ चे विधानसभा विधेयक क्रमांक १६.
स्पर्धा परीक्षांमधील अनुचित मार्गास प्रतिबंध करण्यासाठी आणि तत्संबंधित किंवा तदानुषंगिक बाबींसाठी तरतूद करण्याकरिता विधेयक.
ज्याअर्थी, स्पर्धा परीक्षांमधील अनुचित मार्गास प्रतिबंध करण्यासाठी आणि तत्संबंधित किवा तदानुषंगिक बाबींसाठी नवीन कायदा अधिनियमित करणे इष्ट आहे त्याअर्थी, भारतीय गणराज्याच्या पंचाहत्तराव्या वर्षी, याद्वारे, पुढील अधिनियम करण्यात येत आहे :-

प्रकरण-एक
प्रारंभिक.
संक्षिप्त नाव व १. (१) या अधिनियमास, महाराष्ट्र स्पर्धा परीक्षा (अनुचित मार्गास प्रतिबंध) अधिनियम, प्रारंभ. २०२४, असे म्हणावे.
(२) तो, राज्य शासन, शासकीय राजपत्रातील अधिसूचनेद्वारे नियत करील अशा दिनांकास अंमलात येईल.
प्रकरण दोन
व्याख्या.
व्याख्या
२. (१) या अधिनियमात, संदर्भानुसार दुसरा अर्थ आवश्यक नसेल तर, -
(क) " उमेदवार" याचा अर्थ, स्पर्धा परीक्षेस बसण्यासाठी स्पर्धा परीक्षा प्राधिकरणाकडून जिला परवानगी देण्यात आलेली आहे अशी व्यक्ती, असा आहे आणि त्यामध्ये, स्पर्धा परीक्षेत तिच्या वतीने लेखनिक म्हणून काम करण्यासाठी प्राधिकृत केलेल्या व्यक्तीचा समावेश होतो;
(ख) " संदेशवहन साधन" यास, माहिती तंत्रज्ञान अधिनियम, २००० याच्या कलम २००० चा २ च्या पोट-कलम (१) च्या खंड (जक) मध्ये जो अर्थ नेमून दिलेला असेल, तोच अर्थ २१. असेल :
(ग) " स्पर्धा परीक्षा" याचा अर्थ, अनुसूचीमध्ये विनिर्दिष्ट केल्याप्रमाणे, स्पर्धा परीक्षा प्राधिकरणाने घेतलेली, किंवा राज्य शासनाद्वारे विनिर्दिष्ट करण्यात येईल अशा अन्य प्राधिकरणाने घेतलेली स्पर्धा परीक्षा, असा आहे;
(घ) " स्पर्धा परीक्षा प्राधिकरण" याचा अर्थ, महाराष्ट्र लोकसेवा आयोग, स्पर्धा परीक्षा घेण्यासाठी राज्य शासनाने, वेळोवेळी, नेमलेली किंवा घटित केलेली निवड समिती अथवा अनुसूचीमध्ये विनिर्दिष्ट केलेले कोणतेही परीक्षा प्राधिकरण, असा आहे ;
(ङ) " स्पर्धा परीक्षा केंद्र याचा अर्थ, स्पर्धा परीक्षा घेण्याकरिता वापर करण्यासाठी सेवा पुरवठादाराने ज्या निवडलेल्या आहेत किंवा स्पर्धा परीक्षा प्राधिकरणाने अन्यथा ज्या निवडलेल्या आहेत आणि ज्यांमध्ये, इतर गोष्टींबरोबरच, कोणतीही शाळा, संगणक केंद्र, संस्था, कोणतीही इमारत किंवा तिचा काही भाग यांचा समावेश होईल अशा जागा, असा आहे आणि त्यांमध्ये, जिचा वापर, सुरक्षेसाठी व स्पर्धा परीक्षा घेण्याच्या इतर संबंधित कारणांसाठी केला जाऊ शकेल, अशा संपूर्ण परिसीमेचा व त्याच्याशी संलग्न जमिनीचा समावेश होईल;
(च) "संगणक नेटवर्क ", " संगणक संसाधन" व " संगणक प्रणाली" यांना, माहिती २००० चा तंत्रज्ञान अधिनियम, २००० याच्या कलम २ च्या पोट-कलम (१) च्या खंड (ञ), (ट) व (ठ) महा. २१. यांमध्ये अनुक्रमे, जे अर्थ नेमून दिलेले असतील तेच असतील;
(छ) " स्पर्धा परीक्षा घेणे" यामध्ये, स्पर्धा परीक्षा घेण्यासाठी अवलंबिण्यात येणा-या विहित करण्यात येईल अशा सर्व कार्यपद्धतींचा, प्रक्रियांचा व क्रियांचा समावेश असेल

(ज) " शासन" याचा अर्थ, महाराष्ट्र शासन, असा आहे;
(झ) संस्था " याचा अर्थ, जे स्पर्धा परीक्षा प्राधिकरण आणि अशा प्राधिकरणाने नेमलेला सेवा पुरवठादार याव्यतिरिक्त आहे असे, कोणतेही अभिकरण, संघटना, निकाय, व्यक्तींचा संघ, व्यवसाय संस्था, कंपनी, भागीदारी संस्था किंवा एकल मालकी असलेली भागीदारी संस्था, मग तिला कोणत्याही नावाने संबोधण्यात येत असो, असा आहे.

१८.स्पष्टीकरण. या खंडाच्या प्रयोजनांसाठी, असे स्पष्ट करण्यात येते की, " कंपनी " यामध्ये, कंपनी अधिनियम, २०१३ याच्या कलम २ च्या खंड (२०) मध्ये व्याख्या केलेल्या कंपनीचा किंवा मर्यादित दायित्व भागीदारी संस्था अधिनियम, २००८ याच्या कलम २ च्या पोट-कलम (१) च्या खंड (ढ) मध्ये व्याख्या केलेल्या मर्यादित दायित्व भागीदारी संस्थेचा समावेश होतो;
६. (ञ) " अधिसूचना " याचा अर्थ, शासकीय राजपत्रात प्रसिद्ध केलेली अधिसूचना, असा आहे आणि "अधिसूचित करणे" या शब्दप्रयोगाचा अर्थ त्यानुसार लावण्यात येईल;
(ट) " संघटित गुन्हा याचा अर्थ, स्पर्धा परीक्षेच्या बाबतीत गैरलाभ मिळवण्यासाठी " सामायिक हितसंबंध जोपासण्याकरिता किंवा त्यास प्रोत्साहन देण्यासाठी संगनमताने व कट करून, अनुचित मागौमध्ये गुंतलेल्या एखाद्या व्यक्तीने किंवा व्यक्तींच्या गटाने केलेली बेकायदेशीर कृत्ये, असा आहे
(ठ) " सेवा पुरवठादाराशी सहयोगी असलेली व्यक्ती याचा अर्थ, जी व्यक्ती, अशा सेवा पुरवठादारासाठी किंवा त्याच्या वतीने सेवा करते, मग अशी व्यक्ती, अशा सेवा पुरवठादाराची कर्मचारी असो किंवा अभिकर्ता असो किंवा, यथास्थिति, दुय्यम संस्था असो,- असा आहे ;
(ड) " प्राश्निक" याचा अर्थ, प्रश्न किंवा प्रश्न पेढी किंवा प्रश्नपत्रिका तयार करण्यासाठी स्पर्धा परीक्षा प्राधिकरणाने नियुक्त केलेली कोणतीही व्यक्ती किंवा संस्था, असा आहे;
(ढ) " विहित याचा अर्थ, या अधिनियमाखाली केलेल्या नियमांद्वारे विहित केलेले, असा आहे ;
(ण) " सेवा पुरवठादार" याचा अर्थ, स्पर्धा परीक्षा घेण्यासाठी स्पर्धा परीक्षा प्राधिकरणाने ज्याची नेमणूक केलेली आहे, असे कोणतेही अभिकरण, संघटना, निकाय, व्यक्तीचा संघ, व्यवसाय संस्था, कंपनी, भागीदारी संस्था किंवा एकल मालकी असलेली भागिदारी संस्था, तसेच कोणतीही संगणक संसाधने किंवा कोणतेही साहित्य यांचा पुरवठा करणारे त्याचे सहयोगी, उप-कंत्राटदार किंवा पुरवठादार, मग त्यांना कोणत्याही नावाने संबोधण्यात येवो,- असा आहे.
(२) या अधिनियमात वापरलेले, परंतु, व्याख्या न केलेले आणि त्या त्या वेळी अंमलात असलेल्या अन्य कोणत्याही कायद्यान्वये व्याख्या केलेले शब्द व शब्दप्रयोग यांना, त्या कायद्यांमध्ये जे अर्थ नेमून दिलेले असतील, तेच अर्थ असतील.

प्रकरण तीन
अनुचित मार्ग.
अनुचित मार्ग व अपराध.
३. स्पर्धा परीक्षा घेण्याशी संबंधित असलेल्या अनुचित मार्गामध्ये, कोणत्याही उमेदवाराने किंवा कोणत्याही व्यक्तीने किंवा व्यक्तींच्या गटाने किंवा संस्थांनी केलेले किंवा करण्याची व्यवस्था केलेले कोणतेही कृत्य किंवा अकृत्य यांचा समावेश असेल, आणि त्यामध्ये, आर्थिक किंवा गैरलाभ मिळविण्यासाठी केलेल्या, परंतु तेवढ्यापुरतेच निर्बंधित नसलेल्या पुढीलपैकी कोणत्याही कृत्यांचा समावेश असेल :-
(एक) स्पर्धा परीक्षेत, कोणत्याही उमेदवाराचा, स्वतः किंवा इतर कोणत्याही व्यक्तीच्या पाठिंब्याने, प्रत्यक्ष किंवा अप्रत्यक्ष सहभाग अथवा परीक्षेत कोणत्याही लिखित, अ-लिखित, उद्धृत, नक्कल केलेल्या, मुद्रित केलेल्या साहित्याचा, इलेक्ट्रॉनिक किंवा माहिती तंत्रज्ञान (आयटी) उपकरणांमधून मिळविलेल्या साहित्याचा बेकायदेशीर वापर करणे अथवा परीक्षेमध्ये कोणतीही अनुचित व इतर अनधिकृत मदत घेणे किंवा कोणतेही अनधिकृत इलेक्ट्रॉनिक किंवा यांत्रिक साधन किंवा उपकरण, इत्यादींचा वापर करणे :
(दोन) परीक्षेमध्ये तोतयेगिरी करणे;
(तीन) प्रश्नपत्रिका किंवा उत्तर तालिका (अॅन्सर की) किंवा त्याचा कोणताही भाग फोडणे :
(चार) प्रश्नपत्रिका किंवा उत्तर तालिका (अॅन्सर की) फोडण्यासाठी इतरांशी संगनमताने सहभाग घेणे :
(पाच) कोणत्याही प्राधिकाराशिवाय, प्रश्नपत्रिका किंवा एखादे ऑप्टिकल मार्क रेकग्निशन रिस्पॉन्स (अनुक्रिया) पत्र किंवा इतर कोणत्याही पद्धतीची उत्तरपत्रिका अनधिकृतपणे मिळविणे किंवा ताब्यात घेणे;
(सहा) स्पर्धा परीक्षेच्या कालावधीत कोणत्याही अनधिकृत व्यक्तीद्वारे, एक किंवा अधिक प्रश्नांची उत्तरे पुरविणे ;
(सात) स्पर्धा परीक्षेमध्ये, कोणत्याही अनधिकृत रीतीने उमेदवारास प्रत्यक्षपणे किंवा अप्रत्यक्षपणे सहाय्य करणे;
(आठ) ऑप्टिकल मार्क रेकग्निशन रिस्पॉन्स (अनुक्रिया) पत्रांसह उत्तरपत्रिकांमध्ये अनधिकृतपणे फिरवाफिरव करणे;
(नऊ) कोणत्याही प्राधिकाराशिवाय वास्तविक दोष दुरूस्त करण्याखेरीज मूल्यनिर्धारणामध्ये फेरफार करणे :
(दहा) राज्य शासनाने किंवा महाराष्ट्र लोकसेवा आयोगाने, स्वतः किंवा तिच्या अभिकरणामार्फत स्पर्धा परीक्षा घेण्यासाठी निर्धारित केलेली मानके किंवा प्रमाणके यांचे जाणीवपूर्वक उल्लंघन करणे;
(अकरा) एखाद्या स्पर्धा परीक्षेमध्ये उमेदवारांची चाळणी यादी (शॉर्ट लिस्ट) तयार करण्यासाठी अथवा उमेदवारांचे गुण किंवा गुणवत्ताक्रम अंतिम करण्यासाठी आवश्यक असलेल्या कोणत्याही दस्तऐवजामध्ये अनधिकृतपणे फिरवाफिरव करणे :
(बारा) स्पर्धा परीक्षा घेताना अनुचित मार्गाचा अवलंब करणे सुकर होण्यासाठी सुरक्षा उपाययोजनांचे जाणीवपूर्वक उल्लंघन करणे

THE PUBLIC EXAMINATIONS (PREVENTION OF UNFAIR MEANS) ACT, 2024

An Act to prevent unfair means in the public examinations and to provide for matters connected therewith or incidental thereto.
Be it enacted by Parliament in the Seventy-fifth Year of the Republic of India as follows:-
CHAPTER 1
PRELIMINARY
1. (7) This Act may be called the Public Examinations (Prevention of Unfair Means) Act, 2024. Short title and commencement.
(2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.
Definitions.
2. (7) In this Act, unless the context otherwise requires,-
(a) "candidate" means a person who has been granted permission by the public examination authority to appear in public examination and includes a person authorised to act as a scribe on his behalf in the public examination;
(b) "communication device" shall have the same meaning assigned to
it in clause (ha) of sub-section (1) of section 2 of the Information
Technology Act, 2000;

(c) "competent authority" shall mean the Ministry or a Department of the Central Government administratively concerned with the public examination authority:
(d) "computer network", "computer resource" and "computer system" shall have the meanings respectively assigned to them in clauses (1), (k) and (/) of sub-section (1) of section 2 of the Information Technology Act, 2000;

(e) "conduct of public examination" shall include all the procedures, processes and activities, as may be prescribed, for being adopted for the conduct of public examination;
("institution" means any agency, organisation, body, association of persons, business entity, company, partnership or single proprietorship firm, by whatever name it may be called, which is other than the public examination authority and the service provider engaged by such authority.
Explanation, For the purposes of this clause, it is clarified that "company" includes a company as defined in clause (20) of section 2 of the Companies Act, 2013; or a limited liability partnership firm as defined in clause (7) of sub-section (1) of section 2 of the Limited Liability Partnership Act, 2008;

(g) "notification" means a notification published in the Official Gazette and the expression "notify" shall be construed accordingly:
(h) "organised crime" means an unlawful activity committed by a person or a group of persons indulging in unfair means in collusion and conspiracy to pursue or promote a shared interest for wrongful gain in respect of a public examination,
(1) "person associated with a service provider" means a person who performs services for or on behalf of such service provider irrespective of whether such person is an employee or an agent or a subsidiary of such service provider, as the case may be;
(/) "prescribed" means prescribed by rules made under this Act;
(k) "public examination" means any examination conducted by the public examination authority, as specified in the Schedule, or conducted by such other authority as may be notified by the Central Government;
(7) "public examination authority" means an authority as specified by the Central Government by a notification, from time to time for conducting the public examinations;
(m) "public examination centre" means such premises, which is
selected by the service provider or otherwise selected by the public
examination authority, to be used for conduct of public examination and
which, amongst others, may include any school, computer centre,
institution, any building or part thereof and the same shall include the entire
periphery and land appurtenant thereto which may be used for security and
other related reasons for conduct of the public examinations; and (n) "service provider" means any agency, organisation, body, association of persons, business entity, company, partnership or single proprietorship firm, including its associates, sub-contractors and provider of support of any computer resource or any material, by whatever name it may be called, which is engaged by the public examination authority for conduct of public examination.
(2) Words and expressions used herein but not defined and defined under any other law for the time being in force, shall have the same meanings as assigned to them in those laws.
CHAPTER II
UNFAIR MEANS AND OFFENCES
3. The unfair means relating to the conduct of a public examination shall
include any act or omission done or caused to be done by any person or group of
persons or institutions, and include but not be restricted to, any of the following
acts for monetary or wrongful gain
Unfair means.
(7) leakage of question paper or answer key or part thereof.
(17) participating in collusion with others to effect leakage of question paper or answer key;
(iii) accessing or taking possession of question paper or an Optical Mark Recognition response sheet without authority;
(iv) providing solution to one or more questions by any unauthorised person during a public examination;
(v) directly or indirectly assisting the candidate in any manner unauthorisedly in the public examination;
(vi) tampering with answer sheets including Optical Mark Recognition response sheets:
(vii) altering the assessment except to correct a bona fide error without any authority;
(viii) willful violation of norms or standards set up by the Central Government for conduct of a public examination on its own or through its agency,
(x) tampering with any document necessary for short-listing of candidates or finalising the merit or rank of a candidate in a public examination;
(x) deliberate violation of security measures to facilitate unfair means in conduct of a public examination;
(x7) tampering with the computer network or a computer resource or a computer system,
(xii) manipulation in seating arrangements, allocation of dates and shifts for the candidates to facilitate adopting unfair means in examinations;
(xiii) threatening the life, liberty or wrongfully restraining persons associated with the public examination authority or the service provider or any authorised agency of the Government; or obstructing the conduct of a public examination;
(xiv) creation of fake website to cheat or for monetary gain, and
(xv) conduct of fake examination, issuance of fake admit cards or offer letters to cheat or for monetary gain.Conspiracy for unfair means.
4. No person or group of persons or institutions shall collude or conspire to facilitate indulgence in any such unfair means.
Disruption to conduct public examination.
5. (1) No person, who is not entrusted or engaged with the work pertaining to the public examination or conduct of public examination or who is not a candidate, shall enter the premises of the examination centre, with intent to disrupt the conduct of the public examination.
(2) No person authorised, engaged or entrusted with the duties to conduct public examination shall, before the time fixed for opening and distribution of question papers-
(a) open, leak or possess or access or solve or seek assistance to solve such question paper or any portion or a copy thereof in unauthorised manner for monetary or wrongful gain;
(6)give any confidential information or promise to give such confidential information to any person, where such confidential information is related to or in reference to such question paper for monetary or wrongful gain.
(3) No person, who is entrusted or engaged with any work pertaining to public examination shall, except where he is authorised in furtherance of his duties so to do, reveal or cause to be revealed or make known to any other person any information or part thereof which has come to his knowledge for any undue advantage or wrongful gain.
Other offences.
6. If any person or group of persons or institution commits any unfair means or offence under sections 3, 4 and section 5, the service provider shall forthwith report the offence to the concerned police authorities and also inform the public examination authority:
Provided that if the service provider resorts to unfair means and commits the offence or is involved in facilitating an offence, the public examination authority shall report the same to the concerned police authorities.
No premises other than examination centre shall be used for public examination.
7. It shall be an offence for the service provider or any person associated with the service provider to cause any premises, other than the examination centre, authorised by the public examination authority, to be alternatively used for the purpose of holding public examination, without the written approval of the public examination authority:
Provided that nothing contained in this section shall be an offence where any change in the examination centre without prior consent of the public examination authority is due to any force majeure.
Offences in respect of service providers and other persons.
8. (1) Any person, including the person associated with a service provider, shall be deemed to have committed an offence if he individually or in collusion with any other person or group of persons or institutions assists any person or group of persons or institutions in any manner unauthorisedly in the conduct of public examination.
(2) Service provider or any person associated with it shall be deemed to have committed an offence if he fails to report incidence of any unfair means or commission of any offence.
(3) Where an offence committed by a service provider is, prima facie,
established during investigation to have been committed with the consent or
connivance of any director, manager, secretary or other officer of such service
provider, such person shall also be liable to be proceeded against:
Provided that nothing contained in this sub-section shall render any such
person liable to any punishment under the Act, if he proves, that the offence was
committed without his knowledge and that he exercised all due diligence to
prevent the commission of such offence.CHAPTER III
PUNISHMENT FOR OFFENCES
9. All offences under this Act, shall be cognizable, non-bailable and non-compoundable.
10. (1) Any person or persons resorting to unfair means and offences under this Act, shall be punished with imprisonment for a term not less than three years but which may extend to five years and with fine up to ten lakh rupees. In case of default of payment of fine, an additional punishment of imprisonment shall be imposed, as per the provisions of the Bharatiya Nyaya Sanhita, 2023:

Provided that until the Bharatiya Nyaya Sanhita, 2023 is brought into force, the provisions of the Indian Penal Code, shall be applicable in place of the said Act.
(2) The service provider shall also be liable to be punished with imposition of a fine up to one crore rupees and proportionate cost of examination shall also be recovered from such service provider and he shall also be barred from being assigned with any responsibility for the conduct of any public examination for a period of four years.
(3) Where it is established during the investigation that offence under this Act has been committed with the consent or connivance of any Director, Senior Management or the persons in-charge of the service provider firm, he shall be liable for imprisonment for a term not less than three years but which may extend to ten years and with fine of one crore rupees. In case of default of payment of fine, an additional punishment of imprisonment shall be imposed as per the provisions of the Bharatiya Nyaya Sanhita, 2023:

Provided that until the Bharatiya Nyaya Sanhita, 2023 is brought into force, the provisions of the Indian Penal Code, shall be applicable in place of the said Act.
(4) Nothing contained in this section shall render any such person liable to any punishment under the Act, if he proves, that the offence was committed without his knowledge and that he exercised all due diligence to prevent the commission of such offence.
11. (7) If a person or a group of persons including the examination authority or service provider or any other institution commits an organised crime, he shall be punished with imprisonment for a term not less than five years but which may extend to ten years and with fine which shall not be less than one crore rupees. In case of default of payment of fine, an additional punishment of imprisonment shall be imposed as per the provisions of the Bharatiya Nyaya Sanhita, 2023:

Provided that until the Bharatiya Nyaya Sanhita, 2023 is brought into force, the provisions of the Indian Penal Code, shall be applicable in place of the said Act.
(2) If an institution is involved in committing an organised crime, its property shall be subjected to attachment and forfeiture and proportionate cost of examination shall also be recovered from it.
CHAPTER IV
INQUIRY AND INVESTIGATION
12. (7) An officer not below the rank of Deputy Superintendent of Police or
Assistant Commissioner of Police shall investigate any offence under this Act.
(2) Notwithstanding anything contained in sub-section (1). the Central Government shall have the powers to refer the investigation to any Central Investigating Agency.

19. In the Criminal Law (Amendment) Ordinance, 1944, in the Schedule, after serial number 5 and entries relating thereto, the following serial number and entries shall be inserted, namely:
"6. An offence punishable under the Public Examinations (Prevention of Unfair Means) Act, 2024.".

6. National Testing Agency.
7. Such other authority as may be notified by the Central Government.
