क्रमांक संकीर्ण-२०२३/प्र.क्र.२२१/आस्था-१४. महाराष्ट्र जिल्हा परिषद व पंचायत समिती अधिनियम, १९६१ (सन १९६२ चा महाराष्ट्र अधिनियम ५) याच्या कलम २७४ च्या पोट-कलम (२) च्या खंड (३९) द्वारे प्रदान केलेल्या अधिकारांचा आणि त्याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासन, याद्वारे, महाराष्ट्र जिल्हा परिषद जिल्हा सेवा (सेवाप्रवेश) नियम, १९६७ मध्ये आणखी सुधारणा करण्यासाठी उक्त कलम २७४ च्या पोट-कलम (३) द्वारे आवश्यक असल्याप्रमाणे, यापूर्वी प्रसिद्ध करण्यात आलेले पुढील नियम तयार करीत आहेः-

१. या नियमांना, महाराष्ट्र जिल्हा परिषद जिल्हा सेवा (सेवा प्रवेश) (सुधारणा) नियम, २०२५ असे संबोधण्यात यावे.

२. महाराष्ट्र जिल्हा परिषद जिल्हा सेवा (सेवा प्रवेश) नियम, १९६७ मध्ये जोडलेल्या परिशिष्टचारमधील (भाग-२) मध्ये अनुक्रमांक ८ नंतर खालीलप्रमाणे नोंद समाविष्ट करण्यात येत आहे.

(१) "८-अ

(२) जिल्हा सेवा (वर्ग-तीन) (दुय्यम शैक्षणिक) प्राथमिक शाळेतील मुख्याध्यापक.

(३) केंद्रप्रमुख

(४) १. केंद्र प्रमुख पदावरील नियुक्ती, एकतर, -(१) (अ) पदोन्नतीसाठी पात्र असणाऱ्या जिल्हा परिषदेमधील प्राथमिक शाळेतील मुख्याध्यापक या पदावर कार्यरत असणाऱ्या व प्रशिक्षित पदवीधर शिक्षक (प्राथमिक) या पदावर ६ वर्षापेक्षा कमी नसेल इतकी अखंड नियमित सेवा असणाऱ्या व्यक्तींमधून, ज्येष्ठतेच्या आधारे, योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल; आणि

(ब) पदोन्नतीसाठी पात्र असणाऱ्या आणि त्या पदावर ६ वर्षांपेक्षा कमी नसेल इतकी अखंड नियमित सेवा असणाऱ्या जिल्हा परिषदेमधील प्रशिक्षित पदवीधर शिक्षक (प्राथमिक) पद धारण करणाऱ्या व्यक्तींमधून पात्रतेच्या अधीन राहून, ज्येष्ठतेच्या आधारे, योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल :

परंतु, उपरोक्त नियम १ (१) येथे नमूद केलेल्या पदावरील पदोन्नतीने नियुक्तीसाठी जिल्हा परिषदेतील प्रशिक्षित पदवीधर शिक्षक (प्राथमिक) संवर्गाची जेष्ठता विचारात घेण्यात येईल.

(२) शालेय शिक्षण व क्रिडा विभागाने वेळोवेळी विहीत केलेल्या धोरण आणि कार्यपद्धतीनुसार, त्यासाठी घेण्यात आलेल्या मर्यादित विभागीय स्पर्धा परीक्षेच्या निकालातून गुणवत्तेच्या आधारावर योग्य उमेदवाराची निवड करून,

(अ) ज्याने, जिल्हा परिषदेमध्ये जाहिरात वर्षाच्या १ जानेवारी या दिनांकास प्रशिक्षित पदवीधर शिक्षक (प्राथमिक) म्हणून किमान ६ वर्ष इतकी अखंड नियमित सेवा केली आहे,

(ब) जो, जिल्हा परिषदेमध्ये प्रशिक्षित शिक्षक (प्राथमिक) हे पद धारण करीत आहे, व ज्याने शालेय शिक्षण विभागाने वेळोवेळी विहित केलेली प्रशिक्षित पदवीधर शिक्षक (प्राथमिक) या पदासाठीची शैक्षणिक अर्हता धारण केली आहे आणि जाहिरात वर्षाच्या १ जानेवारी या दिनांकास किमान ६ वर्ष इतकी अखंड नियमित सेवा केली आहे.

२. केंद्रप्रमुख पदावरील नियुक्ती ही पदोन्नतीने आणि निवडीद्वारे अनुक्रमे ५०:५० या प्रमाणात करण्यात येईल.

३. (अ) केंद्रप्रमुख पदावर नियुक्त केलेली व्यक्ती, -

(१) ज्या जिल्ह्यात त्याने जिल्हा परिषदेच्या प्राथमिक शाळेचे मुख्याध्यापक किंवा प्रशिक्षित पदवीधर शिक्षक (प्राथमिक) म्हणून काम केले होते, त्याच जिल्ह्यामध्ये जिल्हास्तरावर ठेवलेल्या ज्येष्ठता यादीच्या आधारे ज्येष्ठतेनुसार, पदोन्नतीसाठी पात्र असेल.

(२) राज्यातील इतर कोणत्याही जिल्हा परिषदेत प्रतिनियुक्तीसाठी किंवा अशा कोणत्याही बदलीसाठी पात्र असणार नाही.

(ब) केंद्रप्रमुख पदावर निवडीद्वारे नियुक्त केलेल्या व्यक्तीची नियुक्ती आणि पदस्थापना यासारख्या सेवा शर्ती ग्रामविकास विभागाने, शालेय शिक्षण व क्रीडा विभागाशी सल्लामसलत करून समुचित साधनाद्वारे वेळोवेळी विहित केलेल्या मार्गदर्शक तत्त्वांनुसार नियंत्रित केल्या जातील.

४. (१) केंद्रप्रमुख पदावर नियुक्त होणाऱ्या व्यक्तीने महाराष्ट्र नागरी सेवा (लहान कुटुंबाचे प्रतिज्ञापन) नियम, २००५ मधील तरतुदींनुसार किंवा त्याबाबत शासनाने वेळोवेळी निर्गमित केलेले अन्य नियम, आदेश किंवा इतर संसाधनानुसार नियुक्तीच्या वेळी लहान कुटुंबाचे प्रतिज्ञापन सादर करणे आवश्यक राहील.

(२) लहान कुटुंबाचे प्रतिज्ञापन सादर केल्याच्या दिनांकास दोनपेक्षा अधिक अपत्ये हयात असलेली व्यक्ती या नियमांनुसार नियुक्त केलेल्या सेवेत नियुक्तीसाठी अपात्र ठरेल. तसेच यासंदर्भात वेळोवेळी निर्गमित होणारे शासन आदेश लागू राहतील.

५. केंद्रप्रमुख पदावर नियुक्त केलेल्या व्यक्तींना महाराष्ट्र जिल्हा परिषदा आणि पंचायत समित्या अधिनियम, १९६१, महाराष्ट्र जिल्हा परिषद जिल्हा सेवा (सेवा प्रवेश) नियम, १९६७ मधील तरतुदी आणि या अनुषंगाने शासनाने वेळोवेळी जारी केलेले कोणतेही नियम, आदेश किंवा कोणतीही संसाधने लागू राहतील."

NOTIFICATION

THE MAHARASHTRA ZILLA PARISHADS AND PANCHAYAT SAMITI Aст, 1961.

No. 2023/C.R.221/Astha-14.-In exercise of the powers conferred by clause (xxxix) of sub-section (2) of section 274 of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 (Mah. V of 1962), and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, makes the following rules, further to amend the Maharashtra Zilla Parishad District Services (Recruitment) Rules, 1967, the same have been previously published as required by sub-section (3) of the said section 274, namely:-

1. These rules may be called the Maharashtra Zilla Parishads District Services (Recruitment) (Amendment) Rules, 2025.

2. In Appendix IV appended to the Maharashtra Zilla Parishads District Services (Recruitment) Rules 1967, in (Part-II), after entry 8, the following entry shall be inserted, namely:-

(1) "8-A

(2) District Services (Class III) (Sub-ordinate Educational)

(3) Kendra Pramukh.

(4) 1. Appointment to the post of Kendra Pramukh, shall be made either,-

(1) (A) by promotion of a suitable person having eligibility for promotion on the basis of seniority from amongst the persons holding the post of Head Master of Primary School of Zilla Parishad and having not less than six years of regular and continuous service on the post of Trained Graduate Teacher (Primary) in Zilla Parishad; and

(B) by promotion of a suitable person having eligibility for promotion on the basis of seniority from amongst the persons holding the post of Trained Graduate Teacher (Primary) in Zilla Parishad and having not less than six years of regular and continuous service on that post:

Provided that, seniority of the cadre of Trained

Graduate Teacher (Primary) in Zilla Parishad

shall be taken into consideration for appointment

by promotion to the post mentioned in Rule 1 (1)

(2) by selection of a suitable candidate on the basis of merit from result of the Limited Departmental Competitive Examination conducted therefor, as per the policy and procedure prescribed by School Education and Sports Department, from time to time, from amongst candidates holding the post of, (i) Trained Graduate Teacher (Primary) in Zilla Parishad and having not less than six years of regular and continuous service in that posts on the 1st of January of the year of advertisement.

(ii) Trained Teacher (Primary) in Zilla Parishad who possess essential qualification to get appointment to the post of Trained Graduate Teacher (Primary), as prescribed by School Education and Sports Department from time to time and having not less than six years of regular and continuous service in that posts on the 1st of January of the year of advertisement.

2. Appointment to the post of Kendra Pramukh shall be made by promotion and selection in the ratio of 50:50.

3. (A) A person appointed to the post of Kendra Pramukh shall,

(i) be eligible for promotion in the same district, in which he had worked as the Head Master of Primary School of Zilla Parishad or Trained Graduate Teacher (Primary) in Zilla Parishad, on the basis of seniority list maintained at district level.

(ii) not be eligible for deputation or any such transfer to any other Zilla Parishad in Maharashtra. (B) The service conditions like appointment and posting, of a person to be appointed to the post of Kendra Pramukh by selection shall be governed by guidelines as prescribed by the Rural Development Department vide suitable instruments in consultation with School Education and Sports Department, from time to time.

4. (1) A person appointed to the post of Kendra Pramukh shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Declaration of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time at the time of appointment.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in Government service. Moreover, the person shall be governed by Government Orders issued from time to time, in this behalf.

5. The provisions of Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961, Maharashtra Zilla Parishads District Services (Recruitment) Rules, 1967 and any rules, orders or any instruments issued in this behalf by the Government, from time to time shall be applicable to the person appointed on the post of Kendra Pramukh."
